Kate Auerbach and Bill Mandell,
represent employers and employees in the following matters:
Employment/Service Contracts We counsel
clients in the negotiation and drafting of employment and other service-related
contracts, including various restrictive covenants, non-competition clauses,
compensation arrangements, bonus plans, stock options and other equity
opportunities. We also counsel our clients on establishing strategic
relationships and developing the most effective legal documents to memorialize
them. Our work in this area also includes representation on the termination of
employment relationships, including severance and separation agreements and
releases. Our clients include employees and employers in the medical,
communications, manufacturing, technology, E-commerce and financial fields. In
the event of disputes or litigation in this area, we work together with our
litigation practice area to provide representation for both employers
and employees.
Separation/Severance Agreements We represent both
employers and employees in the negotiation and drafting of separation and
severance agreements and releases.
Employment Regulation We advise our clients
regarding their rights and responsibility under the Americans with Disabilities
Act, Family Medical Leave Act, COBRA and other similar federal and Massachusetts
employment laws.
Employment Litigation Our litigators handle all
facets of employment disputes including termination and severance matters, the
enforcement of covenants-not-to-compete and other restrictive covenants, and
confidentiality agreements. Our trial attorneys also have extensive experience
litigating workplace discrimination and harassment claims in state and federal
courts, as well as the Massachusetts Commission Against Discrimination. We also
have successfully represented clients in litigation involving disability
insurance and other employee benefits, including the application of federal
ERISA laws to claims involving such benefits.
